The Chief Judge of the Federal High Court of Nigeria, Justice John Tsoho, has dismissed the request by Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), for Justice Binta Nyako to recuse herself from his ongoing trial. Justice Tsoho has returned the case to Justice Nyako, citing that two other judges had previously recused themselves from the matter.
Kanu’s case, which dates back to 2015, was reassigned to Justice Nyako due to its prolonged nature. According to Tsoho, since she has presided over the case for the majority of its duration, she is the most suitable judge to continue and conclude the trial.
However, Justice Tsoho instructed that if Kanu persists in seeking Justice Nyako’s recusal at the next hearing, he must file a formal written motion on notice, accompanied by an affidavit detailing the grounds for his request. Kanu must also serve the motion on the prosecution team and appear before Justice Nyako for her to review and determine the matter.
Kanu’s special lawyer, Aloy Ejimakor, confirmed the development in a statement to Channels Television, adding that they are awaiting official court notice and a new hearing date.
Justice Nyako had earlier recused herself from the case following an oral application by Kanu and his lawyer, citing a loss of confidence in her handling of the case, accusing her of disregarding Supreme Court orders.
