The absence of Justice Inyang Ekwo of the Federal High Court in Abuja on Monday has delayed the hearing of a ₦50 billion lawsuit filed by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), against the Federal Government.
The case, which was scheduled for hearing, could not proceed as Justice Ekwo was reportedly on official assignment, presiding over another division of the court.
Change of Counsel in Focus
During a previous proceeding, Kanu’s lawyer, Aloy Ejimakor, informed the court of his intention to take over the case from Mike Ozekhome, who initially filed the suit on April 7, 2022. Ejimakor had filed a notice of change of counsel to formalize his role in representing Kanu.
Details of the Lawsuit
The lawsuit, naming the Federal Republic of Nigeria and the Attorney-General of the Federation (AGF) as the 1st and 2nd defendants, centers on alleged violations of Kanu’s fundamental rights. Kanu claims he was unlawfully abducted from Kenya and forcibly returned to Nigeria to face trial, an action he describes as extraordinary rendition.
Kanu’s legal team is seeking a determination on whether his abduction and subsequent rendition comply with Nigerian and international laws. The suit also demands ₦50 billion in damages for the alleged violation of his rights.
The case is expected to resume once Justice Ekwo is available to preside.
